NIP Wizard Responses
These were the responses used by the Wizard to arrive at its recommendation:
Have you received a NIP? - Yes
Are you the Registered Keeper of the vehicle concerned (is your name and address on the V5/V5C)? - Yes
Did the first NIP arrive within 14 days? - Yes
Although you are the Registered Keeper, were you also the keeper of the vehicle concerned (the person normally responsible for it) at the time of the alleged offence? - Yes
Were you driving? - Yes
Which country did the alleged offence take place in? - England

NIP Wizard Recommendation
Based on these responses the Wizard suggested that this course of action should be considered:
  • The law requires you to provide the information requested in the Section 172 notice within the 28 day period, naming yourself as the driver. If you are considering obtaining formal legal advice, do so before returning the notice.

You should note that there is nothing to be gained by responding any earlier than you have to at any stage of the process. You are likely to receive a Conditional Offer of a Fixed Penalty (COFP) and further reminder(s). If you want to continue the fight, you should ignore all correspondence from the police until you receive a summons. You need to understand from the outset that while you will receive much help and support from members on the forums, you will need to put time and effort into fighting your case and ultimately be prepared to stand up in court to defend yourself.

Any question?

What's the speed listed on the NIP?
The Rookie
The course of action the police take will be determined by your alleged speed and the limit, so let us know and we can tell you.

If you didn't notice the camera how would you know it didn't flash?

The camera doesn't have to be noticed, or even noticeable, for you to be convicted. Some types of camera flash, some do not.

This appears to be a Gatso (or at least was a year ago) which will flash, 70mph limit (for cars and Car derived vans only).

As The Rookie said above, it's a 70mph limit for cars (and car-derived vans). Assuming you were in a car / CDV or on a motorbike, you should be offered a speed awareness course (no points) for being clocked at up to 85mph.

Just as a general point for a new driver, assuming you're local - having done quite a bit of driving down there over the last few years, there are a few speed cameras in that general vicinity, including a section under average speed cameras around the A38/A380/A30 junction. It's certainly an area where you'll want to keep a close eye on your speed.

If it's where I think it may have been upgraded to AVS last year but I'm not 100%

That would explain why OP reports he didn't see a flash

I travel that bit of road regularly, the cameras are very visible and very well signposted.

If you missed them then you're going to have to take this one on the chin.
